Hurricane Irene Update: 50 Million People Could Be Affected

Parts of the southeastern United States were already experiencing dangerous swells and rip tides Thursday as Hurricane Irene exited the Bahamas. On Friday afternoon, ahead of Hurricane Irene's forecasted arrival in North Carolina tomorrow, high waves and storm surge were beginning to impact the state's Outer Banks, according to catastrophe modeling firm AIR Worldwide, which is tracking the storm and reported on its possible route and effects late Friday afternoon.

Dr. Tim Doggett, principal scientist at AIR Worldwide, said that the current forecast indicates Irene will likely hit North Carolina's Outer Banks rather than bypassing them, and go on to make a second landfall on or near Long Island, New York. Virginia, Maryland, Delaware, New Jersey, Connecticut, Massachusetts, Rhode Island and Vermont are all in the vicinity of Irene's projected path, meaning the major cities of New York, Philadelphia, Washington D.C. and Boston are projected to be affected by tropical storm conditions.

Included in this class is a general discussion of the Federal Miller Act and general state statutes which require bonds on public works projects. As a prelude to the topic of bid bonds, the public works bidding process is covered.

Bid bonds, performance bonds, and payment bonds each receive separate and extensive treatment in this series. Major clauses within each of these bond forms are discussed using the American Institute of Architects forms as a guide. The distinctions between first and second tier claimants in performance bonds are covered along with an examination of the notice and claim content provisions of each bond.

Contractor default, concentrating mainly on financial failures, is also reviewed in this two-part series. This section's goal is to move producers from being reactive to proactive in recognizing signs of contractor distress. The function of the general indemnity agreement is presented as part of this discussion.

Former New York Governor Eliot Spitzer has been hit with a $60 million libel lawsuit by a former Marsh & McLennan Cos. executive over a column posted on Slate.com concerning an insurance bid-rigging scandal.

William Gilman, a former Marsh executive marketing director, said Spitzer acted with "actual malice" by suggesting in an Aug. 22, 2010 column titled "They Still Don't Get It" that he was guilty of crimes, including crimes he was never accused of, after his conviction had been thrown out the prior month.

Group of Allstate Agents Vote to Unionize

A group of Allstate agents who say the insurer controls them like employees rather than as independent contractors voted to affiliate with a union -- a move the agents hope will help dissolve some of their concerns over employment status.

Members of the Gulfport, Miss.-based National Association of Professional Allstate Agents (NAPAA) approved overwhelmingly to affiliate with the Office and Professional Employees International Union (OPEIU), AFL-CIO. Secret ballots were mailed to the NAPAA's 1,200 NAPAA members and more than 94 percent voted in favor of affiliating with OPEIU, according to the association. The vote was administered by the American Arbitration Association (AAA) and was counted at the AAA's New York office.
